1. Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website located at monarcstudio.co (the "Site") and any services provided by Monarc Studio ("we", "us", or "our"). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

2. Services

Monarc Studio provides design services including brand identity, digital design, art direction, motion and visual design, editorial design, and creative strategy. The specific scope, deliverables, timeline, and commercial terms of any client engagement are governed by a separate written Project Agreement between Monarc Studio and the client.

3. Use of This Website

You may use this Site only for lawful purposes and in accordance with these Terms. You agree not to: use the Site in any manner that violates applicable law; attempt to gain unauthorised access to any part of the Site; introduce any malicious code or software; or reproduce, modify, or commercially exploit any content from the Site without our prior written permission.

4. Intellectual Property

All content on this Site — including but not limited to text, photography, case study materials, graphics, and the Monarc Studio wordmark — is the intellectual property of Monarc Studio and is protected by applicable copyright and trademark law. You may not reproduce, distribute, or commercially use any content from this Site without our express written consent.

Work produced for clients under a Project Agreement is subject to the intellectual property provisions of that Agreement. In the absence of specific contractual provisions, all creative work remains the intellectual property of Monarc Studio until full payment has been received, at which point agreed rights transfer to the client as specified in the Project Agreement.

5. Portfolio Use

Unless expressly agreed otherwise in writing, Monarc Studio reserves the right to feature work produced for clients in our portfolio, case studies, social media, and press materials. If you require confidentiality regarding a project, please notify us in writing before the project commences and we will accommodate your requirements in the Project Agreement.

6. Enquiries and Contact Form

Submitting an enquiry through our contact form does not create a contractual relationship between you and Monarc Studio. Any engagement for services is subject to a separate written Project Agreement. We reserve the right to accept or decline any enquiry at our sole discretion.

7. Disclaimer of Warranties

This Site and its content are provided on an "as is" basis without warranties of any kind, express or implied. Monarc Studio makes no representation that the Site will be uninterrupted, error-free, or free from harmful components. We disclaim all warranties to the fullest extent permitted by applicable law.

8. Limitation of Liability

To the fullest extent permitted by law, Monarc Studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of this Site or our services. Our total liability to you for any claim shall not exceed the greater of £100 or the amount paid by you to Monarc Studio in the three months preceding the claim.
